These Terms of Service ("Terms") govern your use of knoxturnalweb.com and describe the general terms under which Knoxturnal Web Consulting ("Knoxturnal Web," "I," "me") provides web design, development, SEO, and support services. By using this website or hiring me, you agree to these Terms.
Using this website
You may browse this site and contact me for business purposes. Please don't misuse it: no attempts to break in or disrupt it, no automated scraping that burdens the site, no spam through the contact form, and no unlawful use.
The content on this site, including text, graphics, the Knoxturnal Web name and owl logo, and site design, belongs to Knoxturnal Web or is used with permission. You may not copy or reuse it without written permission, except for normal sharing of links.
Information on this site
Articles, pricing, and service descriptions are provided for general information. Prices shown on the site are starting points; your actual price is set in a written proposal based on your project's scope. I try to keep everything accurate, but I don't guarantee the site is always complete, current, or error-free.
Services and agreements
Each project begins with a written proposal, quote, or service agreement that describes the scope, deliverables, timeline, and price. If that document conflicts with these Terms, the signed proposal or agreement controls. Anything not included in the agreed scope is out of scope and may be quoted separately.
Your responsibilities
- Provide content, images, feedback, approvals, and account access on time. Delays on your side may move the schedule.
- Make sure you own or have permission to use any content, images, logos, or trademarks you provide.
- Make sure the information on your website, including any claims, prices, and legal policies, is accurate and lawful for your business.
- Keep your own accounts (hosting, domain, email, Google, payment processors) in your name and paid up.
Payment
Payment terms are set in your proposal. Unless the proposal says otherwise, projects require a deposit before work begins, with the balance due at launch or delivery. Monthly services are billed in advance and continue until cancelled. Work may be paused, and sites may not be launched, while invoices are overdue. Third-party costs such as hosting, domains, plugins, themes, and stock images are your responsibility unless included in the proposal.
Revisions and changes
Proposals include a set number of revision rounds. Additional revisions and changes to the agreed scope are billed at my current hourly rate or quoted as a change order before the work is done.
Ownership of work
Once your project is paid in full, you own the final website design, content created specifically for you, and the deliverables listed in your proposal. Until then, those materials remain the property of Knoxturnal Web.
Third-party software (such as WordPress, Shopify, plugins, themes, fonts, and stock images) remains subject to its own licenses. I keep ownership of my general tools, code snippets, templates, and know-how, and grant you a permanent license to use them as part of your website.
Unless you ask me not to in writing, I may show completed work in my portfolio and marketing, and include a small credit link in your site's footer, which you may remove.
No guaranteed results
I'll do careful, professional work, but search rankings, traffic, leads, and sales depend on factors I don't control, including search engine algorithms, competition, and your market. I don't guarantee specific rankings or business results.
Third-party services
Websites rely on outside services such as hosting providers, domain registrars, CMS platforms, plugins, payment processors, and Google. I'm not responsible for their outages, policy changes, price changes, or security incidents, although I'll help you respond to them under a support plan or at my hourly rate.
Confidentiality
I keep your non-public business information and account access confidential and use them only to do your work. See the Privacy Policy for details on how personal information is handled.
Disclaimer and limitation of liability
This website and my services are provided "as is" except as expressly stated in your proposal or agreement. To the fullest extent allowed by law, Knoxturnal Web is not liable for indirect, incidental, special, or consequential damages, such as lost profits, lost data, or business interruption. My total liability for any claim related to a project is limited to the amount you paid me for that project in the 12 months before the claim.
You agree to hold Knoxturnal Web harmless from claims arising from content or materials you provide, or from your use of the website after delivery.
Ending a project
Either of us may end a project with written notice. You'll pay for work completed up to that point and any non-refundable third-party costs; deposits cover work already started and are non-refundable once work begins unless your agreement says otherwise. Monthly services can be cancelled with notice before the next billing date.
Governing law
These Terms are governed by the laws of the State of California. Any dispute will be handled in the state or federal courts located in Los Angeles County, California, and we'll first try in good faith to resolve it informally.
Changes to these Terms
I may update these Terms from time to time. The "Last updated" date at the top shows when they last changed. Changes don't affect a signed proposal or agreement already in place.
